Terms of Service

Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of secret.pics (the "Service"). The Service is operated by Menoux Studio, a French société par actions simplifiée à associé unique (SASU) with share capital of €1,000, registered under RCS Rennes 931 785 893, whose registered office is at 41 rue Danton, 35700 Rennes, France ("we", "us", or "our"). By using the Service — whether you create a game or play one — you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you purchase a paid plan, our Terms of Sale also apply to that purchase.

Who may use the Service

You must be able to form a binding contract to use the Service, and you must use it in compliance with these Terms and all applicable laws. To create games you must be at least the age of majority in your place of residence. Certain games may be restricted to users aged 18 or older; where a game is age-restricted, you must truthfully confirm your age to continue.

The Service

secret.pics lets creators upload an image, cover parts of it with numbered masks, and assign each mask a challenge (a quiz answer that is checked automatically, or a photo task the creator approves). Players lift masks by completing challenges until the picture is revealed. Playing does not require an account; creating games does. Features may change, and we may add, modify, or discontinue parts of the Service.

Accounts

When you create an account you are responsible for keeping access to it secure and for all activity that occurs under it. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

Your content and license

You retain ownership of the images, text, and other materials you submit to the Service ("Your Content"). You grant secret.pics a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for example, to generate masked composites and previews), and display Your Content solely to operate, provide, and improve the Service.

You represent and warrant that you own or have the necessary rights to Your Content and to the people depicted in it, and that Your Content and your use of the Service do not infringe or violate anyone’s rights or any law.

Acceptable use

You agree not to use the Service to create, upload, share, or solicit content that:

• is sexually explicit, pornographic, or otherwise not safe-for-work; secret.pics is a safe-for-work platform and explicit content is not permitted;
• is illegal, or that depicts, promotes, or facilitates child sexual abuse, violence, terrorism, or hate;
• is non-consensual, invades privacy, or shares another person’s private or identifying information without permission;
• infringes intellectual property, publicity, or other rights;
• is deceptive, fraudulent, or harmful, or that distributes malware;
• harasses, threatens, or defames others.

Playing, guesses, and rewards

Games may limit the number of guesses per day and may offer optional rewarded videos in exchange for additional tries. Any prize, discount code, or reward shown at the end of a game is set and provided by the game’s creator, not by secret.pics; we are not responsible for creators’ rewards or for honoring them.

Advertising

The Service may display advertising on eligible safe-for-work games, provided by third parties including Google. Advertising and the cookies associated with it are described in our Privacy Policy.

Content moderation and reporting

We screen uploads automatically and provide a Report link on every game so anyone can flag content. We may review, remove, restrict, or withhold content and may suspend or terminate accounts that violate these Terms or the law. If you believe content on the Service is unlawful or infringing, use the Report link or contact us so we can act.

Intellectual property

The Service itself, including its software, design, and the secret.pics name and logo, is owned by us and protected by law. Except for Your Content, we grant you no rights in the Service other than the limited right to use it under these Terms.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content is accurate.

Limitation of liability

To the maximum extent permitted by law, secret.pics and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless secret.pics and its operators from any claims, damages, liabilities, and expenses arising out of Your Content, your use of the Service, or your violation of these Terms or the rights of any third party.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

Governing law and changes

These Terms are governed by French law, without regard to its conflict-of-laws rules, and subject to any mandatory consumer-protection rights you have in your country of residence. The competent courts are those of Rennes, France, except where mandatory law lets a consumer bring proceedings before the courts of their place of residence. We may update these Terms from time to time; when we do, we will revise the "Last updated" date above, and your continued use of the Service means you accept the updated Terms.
