Terms of Sale

Scope
These Terms of Sale govern the purchase of paid subscriptions to secret.pics (the "Plans") from Menoux Studio (SASU, RCS Rennes 931 785 893, registered office 41 rue Danton, 35700 Rennes, France). They apply in addition to our Terms of Service and Privacy Policy. Free use of secret.pics is not a sale and is governed solely by the Terms of Service.
By subscribing to a paid Plan you accept these Terms of Sale as in force on the date of your order.
Plans and features
The available Plans, their features, and their prices are described on our pricing page (secret.pics/pricing). Paid Plans currently include Creator Pro and the Business tiers (Starter, Growth, Scale). We may change the features of a Plan; where a change is materially unfavourable to you, you may cancel as described below.
Prices and payment
Prices are shown on the pricing page in euros and are billed monthly in advance. We are not subject to VAT: "TVA non applicable, art. 293 B du CGI" (VAT exemption under article 293 B of the French General Tax Code), so no French VAT is added. Where local taxes apply in your country, they are added at checkout if required.
Payment is processed by our payment provider, Stripe. By subscribing, you authorise us, through Stripe, to charge the recurring subscription fee to your chosen payment method. Your subscription starts when your first payment is confirmed.
Subscription term, renewal, and cancellation
Subscriptions run for successive one-month periods and renew automatically for a further month unless cancelled. You may cancel at any time from your account or by contacting contact@secret.pics; cancellation takes effect at the end of the current paid period, and you keep access to the Plan until then.
For consumers, article L. 215-1 of the French Code de la consommation and its information on tacit renewal apply; you can end automatic renewal at any time with effect from the end of the current period.
Right of withdrawal (consumers)
If you are a consumer in the European Union, you normally have 14 days from the start of your subscription to withdraw without giving a reason (article L. 221-18 of the Code de la consommation).
Because a paid Plan is digital content and online services supplied immediately, when you subscribe you expressly request that we begin performance during the withdrawal period and you acknowledge that you thereby lose your right of withdrawal once the service has been fully performed, in accordance with article L. 221-28 of the Code de la consommation. Where the service has only been partially performed, any refund is reduced in proportion to what has already been supplied.
Refunds
Except for the statutory withdrawal right above and any mandatory consumer rights, subscription fees already paid are non-refundable, including for partially used periods. If we discontinue a paid Plan mid-period, we will refund the unused portion of that period.
Availability and support
We aim to keep the Service available but do not guarantee uninterrupted access; we may carry out maintenance and may suspend access as described in the Terms of Service. Support is provided by email at contact@secret.pics.
Liability
Our liability in connection with a paid Plan is governed by the "Disclaimers" and "Limitation of liability" sections of our Terms of Service, subject to any liability that cannot be excluded under applicable law, including mandatory consumer-protection and product-conformity rules.
Consumer mediation
In accordance with articles L. 611-1 et seq. of the French Code de la consommation, if a dispute cannot be resolved after you have first contacted us in writing, you may, as a consumer, refer it free of charge to our consumer mediator: CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris, France — https://www.cm2c.net (contact@cm2c.net, +33 1 89 47 00 14). You may submit your request directly on the CM2C platform at https://www.cm2c.net.

Governing law and disputes
These Terms of Sale are governed by French law, subject to any mandatory consumer-protection rights you have in your country of residence. The competent courts are those of Rennes, France, except where mandatory law lets a consumer bring proceedings before the courts of their place of residence.
